What is a commercial tenancy agreement?

A commercial tenancy agreement is a contract that aims to protect the interests of the landlord and tenant. It allows the tenant to run their business in a commercial property on the condition that they pay for the lease and follow the rules set out in the agreement.

What should be included in a tenancy agreement?

Written tenancy agreements should include: (Not exhaustive)

  • Address of the rental property
  • Any service charges
  • Break clauses
  • Date the agreement begins
  • Dilapidation clauses
  • Forfeiture clause (this is a rule under which the landlord can end the tenancy)
  • Name of tenant (or company name)
  • Name of the landlord
  • Rent amount and due date (monthly or quarterly)
  • Responsibilities of the tenant
  • Services provided (such as maintenance and repairs)
  • Term of the tenancy (how long it will last)
  • Terms of rental increase
  • etc

Why do the costs vary in drafting or reviewing a lease agreement?

The costs may vary depending on the amount of work involved in drafting, negotiating, agreeing, reviewing or granting a lease. There are a number of factors to consider, such as:

  • Is there a break clause
  • Is there a rent review
  • The length of the lease
  • The level of rent
  • Reviewing responsibilities
  • Whether or not there is a service charge
  • Will a guarantor be required

Tenants may also want to fit out the premises when they move in and this would need to be negotiated with the landlord early on in the lease negotiations.
